Ahmed Bola Tinubu, the All Progressive Congress’ presidential candidate, has no open cases or criminal investigations with the police anywhere in the nation, according to Inspector General of Police (IGP) Usman Alkali Baba, who testified before a Federal High Court sitting in Abuja.

The IGP revealed this in response to a civil group’s petition asking for a mandamus ruling compelling him to detain Tinubu and bring charges against him for perjury and forging certificates.

A civil society organization (CSO), the Incorporated Trustees of the Center for Reform and Public Advocacy, had asserted that Tinubu had lied under oath when he submitted his credentials to the Independent National Electoral Commission (INEC) in 1999 while running for governor of Lagos state.

The IGP, however, claimed that without any known offense committed, the police lacked the authority to bring charges against Tinubu through the counsel of Wisdom Madaki.

He pointed out that the Supreme Court had ruled on the claims in the two petitions against Tinubu in a case brought by the late Chief Gani Fawehinmi, a leading human rights activist, in 2002.

Alkali emphasized that there was no need for the police to restart the case because the Supreme Court had already decided the issue.

The IGP further stated that the police do not require a court order to make an arrest and bring charges because their authority comes from the Constitution and laws when he asked the Federal High Court to dismiss the lawsuit brought against him and the Nigeria Police Force for lack of merit and jurisdiction.

The request for further time to review the counter affidavit police and respond formally was granted by Justice Inyang Ekwo in her decision on the case on Tuesday, November 1.

Ekwo subsequently set January 19, 2023, as the date for the suit’s hearing.
